The application of ISO 26262 Functional Safety encompasses significant legal question relative to the responsibilities for the participants signing off requirements for safety. The scope of responsibilities to explain and document assumptions and conclusions has bee highlighted by two Orders of the US-NHTSA related to the recall cases in connection with airbag not deploying correctly. These orders might serve as guidelines to comply with legal requirements. The author has dealt with the context during at workshop at the IQPC-ISO 26262- Congress in Berlin on March 23, 2015.
